Is this installation compliant?

Hi all,
We had a new Fox Ess KH 9.9 Inverter and battery system installed this week. Everything has been working well, except for a couple of issues which may be related.
Our inverter is installed (outside) above our battery, as I believe is fairly common. I sent a pic of our install to a friend, and they suggested that the inverter might be installed too close to the battery. I've attached a pic of the install.
I've been trying all week to get a ruling from our installer on this but so far I haven't had a response. Does anyone else have an install that is this close? Or does someone know what required minimums Fox specifies?
Also, today is the first hot day we've had since the install went in. It's been about 30 degrees since about 9am. I've noticed the inverter is reporting an internal temperature of about 65 degrees c, and has been significantly throttling its output. I'm wondering if this might be due to poor air circulation because of how close the battery is? Or perhaps some heat coming off the battery that's affecting the inverter?
Any feedback anyone has would be much appreciated.
